TERMS & CONDITIONS

These Terms and Conditions govern your use of Qontinenta LLC’s travel advisory and booking services. By booking with Qontinenta, you acknowledge and accept the terms outlined below, including limitations of liability, responsibilities, and dispute procedures. Please review carefully before confirming your trip.
0. GENERAL TERMS & LEGAL NATURE OF THIS AGREEMENT
This document constitutes an official public offer by Qontinenta LLC (hereafter “Company” or “Qontinenta”) to enter into a service agreement under the terms outlined below. It applies to all services provided by Qontinenta through direct communication or via its official website: https://qontinenta.com.

A binding contract between you (the “Client”) and Qontinenta is formed only once we issue written booking confirmation and have received your payment in full or in part, as specified in your invoice.
By making a booking, you confirm that you have the authority to accept these Terms & Conditions on behalf of all persons named in the booking. The person making the booking (the “lead traveler”) assumes responsibility for all payments due, for ensuring that all passenger details are correct, and for receiving all communications and travel documents on behalf of all travelers.
Written form is considered legally satisfied through electronic correspondence, including email or other digital means of communication.

Qontinenta acts solely as a travel advisor and intermediary between the Client and independent third-party service providers (“Suppliers”) such as hotels, local operators, transport companies, and guides. Qontinenta does not directly operate or provide these services and is not liable for the independent performance or actions of Suppliers.

By submitting a booking request through our website or by email, and by making payment, the Client confirms acceptance of these Terms & Conditions, which form an integral part of the binding agreement between the parties.
Acceptance is recorded through digital confirmation (e.g., selection of a checkbox during online booking or written consent via email).
1. SUBJECT OF AGREEMENT
Qontinenta undertakes, upon the Client’s request, to arrange, book, and coordinate the travel services as outlined in the booking request (“Itinerary” or “Proposal”). The Client agrees to pay for the services as invoiced.

The term “Client” includes all travelers for whom the booking is made, including minors and any accompanying persons.

The travel product may include:
  • Hotel accommodations
  • Transfers and local transport
  • Guided tours and excursions
  • Entrance tickets
  • Other services specified in your personalized itinerary
Airfare, travel insurance, and visa-related services are not included unless explicitly stated in writing by Qontinenta.
2. ACCEPTANCE OF CLAIMS
Any claims regarding the quality or execution of services must be submitted in writing within 30 calendar days after the end of the trip. Claims submitted after this period will not be considered. Supporting documentation (e.g., receipts, photos, written communication) is required for processing.
3. OUR ROLE AS A TRAVEL ADVISOR
Qontinenta does not operate tours or deliver travel services directly. We work with licensed and vetted local service providers (“Suppliers”). Each Supplier operates under its own terms and conditions, which apply in addition to Qontinenta’s.

Qontinenta is not responsible for cancellations, changes, or issues related to services not booked through us — such as airline tickets, insurance, visa support, or third-party excursions.
4. PAYMENTS & BOOKING TERMS
Payment Terms:

  • Full payment is required at the time of booking unless otherwise agreed in writing.
  • All payments are securely processed via Stripe.
  • Prices are in USD; currency conversion fees are the responsibility of the Client.
  • Payment confirmation and invoice are sent via email.
Prices are per person, based on double occupancy, and include only the services explicitly outlined in your itinerary.
5. CANCELLATIONS & REFUNDS
Unless otherwise specified, Qontinenta’s general cancellation policy is:

  • 30+ days before travel – Full refund
  • 15–29 days – 50% refund
  • 14 days or less – No refund

During high-demand periods (e.g., Formula 1, holidays), certain bookings may be non-refundable from the moment of confirmation. You will be notified of these exceptions prior to booking.
Refunds, when applicable, are processed within 14 business days. All cancellations or changes must be submitted in writing.
6. CHANGES BY QONTINENTA
Qontinenta may make minor changes to your itinerary due to operational needs. Minor changes do not entitle you to compensation or refund and may include:

  • Replacing a hotel with one of similar or higher category
  • Assigning a different guide
  • Adjusting timing of activities

Major changes are defined as:

  • Change of destination country
  • Trip shortened by more than 24 hours
  • Downgrade of service or accommodation level

In such cases, you may choose to:

  • Accept the revised itinerary, or
  • Cancel and receive a full refund of monies paid to Qontinenta
7. CHANGES BY CLIENT
Change requests after confirmation must be submitted in writing. We will do our best to accommodate your request, subject to availability and Supplier terms.

  • Some bookings may be non-changeable
  • Additional charges may apply
  • Unused services during travel are non-refundable
8. RIGHT TO CORRECT ERRORS & OFFER VALIDITY
We reserve the right to correct pricing or service errors. In such cases, we will:

  • Adjust your invoice, or
  • Offer you the right to cancel and receive a full refund

All offers are subject to availability and may be modified or withdrawn at any time.
9. CLIENT RESPONSIBILITIES
By booking, you confirm that:

  • You are 18 years or older
  • You are authorized to book on behalf of all travelers
  • All information provided is accurate and complete
  • You accept all terms outlined by Qontinenta and its Suppliers
10. TRAVEL DOCUMENTS & REQUIREMENTS
You are responsible for securing the following before departure:

  • Valid passport
  • Entry visa(s)
  • Health documentation and vaccinations

Qontinenta is not liable for denied entry, missed flights, or disruptions caused by incorrect or missing documentation. All details must match your official travel documents.
11. LIMITATION OF LIABILITY
Qontinenta is not liable for:

  • Injuries, losses, delays, or damages caused by Suppliers
  • Events beyond our control (force majeure, strikes, border closures, pandemics)
  • Services not booked through Qontinenta
  • Acts of negligence by third-party providers

Any legal claim shall be limited to the total fees paid directly to Qontinenta, excluding third-party costs.
12. FORCE MAJEURE
Qontinenta is not responsible for any disruption or cancellation due to:

  • Natural disasters
  • War, terrorism, or civil unrest
  • Strikes or supplier insolvency
  • Pandemic outbreaks
  • Government-imposed travel restrictions

Refunds in such cases depend solely on Supplier policies.
13. TRAVEL INSURANCE
Travel insurance is strongly recommended and may cover:

  • Trip cancellations or delays
  • Medical emergencies
  • Lost or stolen luggage
  • Supplier default or failure

Qontinenta does not sell insurance but can refer you to licensed providers. If declined, we may require a signed waiver.
14. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Florida, USA. Disputes shall be resolved in the courts of Miami-Dade County.

Before pursuing legal action, both parties agree to attempt resolution through mediation within 30 days of written notice of dispute.
15. CHANGES TO THESE TERMS
We reserve the right to update these Terms & Conditions at any time without prior notice. The most recent version will be published on our website. It is your responsibility to review these Terms before booking.

We also reserve the right to:

  • Modify or remove any published product or service
  • Refuse or cancel any booking in case of fraud, error, or non-compliance
  • Replace hotels, guides, or services with comparable alternatives if needed
